Zwangsstilllegung Kfz
In einigen Fällen kann die Ordnungsbehörde eine Zwangsstilllegung Deines Fahrzeuges beantragen. Dies ist auch der Fall, wenn Deine Hauptuntersuchung schon länger abgelaufen ist. Alles, was Du über die Zwangsstilllegung wissen musst, erklären wir Dir hier!
Was ist eine Zwangsstilllegung?
Eine Zwangsstilllegung oder Zwangsabmeldung kann erfolgen, wenn bestimmte Kriterien zur Zulassung zum Straßenverkehr für Dein Fahrzeug nicht oder nicht mehr vorliegen. Die Ordnungsbehörde informiert den Fahrzeughalter zunächst darüber, dass eine Zwangsstilllegung droht. Im Regelfall besteht noch die Möglichkeit, die Mängel zu beseitigen, damit das Fahrzeug nicht zwangsweise stillgelegt werden muss.
Kommt es jedoch zu einer Zwangsabmeldung, bedeutet dies für Dich die Entsiegelung der Nummernschilder und das Einziehen Deines Fahrzeugscheins bzw. der Zulassungsbescheinigung Teil I.
Übrigens: Aufgrund der Amtshilfe können in Deutschland auch ausländische Kennzeichen entsiegelt werden. Hierfür bedarf es einer Aufforderung durch die Ordnungsbehörde.
Welche Gründe kann eine Zwangsstilllegung haben?
Die Ordnungsbehörde veranlasst eine Zwangsabmeldung, wenn erhebliche Mängel vorliegen. Ein erheblicher Mangel besteht, wenn Dein Fahrzeug keine gültige Zulassung hat.
Dies ist aus den folgenden verschiedenen Gründen möglich:
Bevor zwangsweise die Stilllegung erfolgt, erhältst Du eine Anordnung mit der Aufforderung, die Mängel zu beseitigen. Die Aufforderung oder Mahnung an den Fahrzeughalter variiert je nach Mangel, jedoch musst Du immer einen entsprechenden Nachweis vorlegen.
Kannst Du die Mängel nicht rechtzeitig beseitigen, kommt es zu einer Stilllegung Deines Fahrzeuges. Nach Erhalt der Ordnungsverfügung darfst Du Dein Fahrzeug nicht mehr im deutschen Straßenverkehr nutzen. Mit der offiziellen Stilllegung Deines Kfz ist das Fahrzeug von der Polizei zur Fahndung ausgeschrieben. Das bedeutet, dass jederzeit Kennzeichen entsiegelt und Zulassungsbescheinigung eingezogen werden können.
Kosten einer Zwangsstilllegung
Kommt es zu einer Stilllegung des Fahrzeuges, fallen hohe Kosten an. In der Regel liegen die Gebühren bei bis zu 300 Euro. Hast Du keine Möglichkeit, die Mängel, die zur Stilllegung führen werden, zu beseitigen, kannst Du das Fahrzeug auch selbst abmelden. In diesem Fall sparst Du Geld: Denn eine Abmeldung bei einer Zulassungsbehörde kostet nur ungefähr fünf bis zehn Euro. Solltest Du Dein Kfz wieder anmelden, musst Du im Regelfall mit einem Betrag von circa zwölf Euro rechnen.
Was passiert nach einer Zwangsstilllegung?
Wurde Dein Kfz durch eine Zulassungsbehörde oder die Polizei wegen Verkehrsunsicherheit stillgelegt und die Nummernschilder entsiegelt sowie der Fahrzeugschein eingezogen, kannst Du eine Wiederzulassung beantragen. Dafür musst Du nur die folgenden Schritte befolgen:

1. Verwaltungsgebühren begleichen: Zunächst musst Du die ausstehenden Kosten begleichen, die bei der Außerbetriebsetzung entstanden sind.

2. Nachweis erbringen: Damit das Fahrzeug wieder zugelassen werden kann, musst Du einen Nachweis für die Beseitigung des Mangels erbringen. Das kann beispielsweise der Reparaturbericht des Mangels sein.

3. Unterlagen vorlegen: Außerdem musst Du Unterlagen wie die Zulassungsbescheinigung Teil I und Teil II und Dein Ausweis vorlegen. Nach dem Entsiegeln der Kennzeichenschilder müssen auch diese mitgebracht werden.
Rechtsgrundlage für die Wiederzulassung ist unter anderem die Fahrzeug-Zulassungsverordnung (FZV), die Straßenverkehrs-Zulassungs-Ordnung (StVZO) und das Kraftfahrzeugsteuer-Gesetz (KraftStG).
Trotz Zwangsabmeldung am Straßenverkehr teilnehmen
Es ist verboten, ein Fahrzeug trotz Ordnungsverfügung der Zwangsabmeldung im Straßenverkehr zu bewegen. Bei einem Nichtbefolgen des Verbots droht ein Bußgeld in Höhe von 70 Euro. Auch ein Punkt in Flensburg gibt es für diesen Verstoß und dem Beitragen zur Verkehrsunsicherheit. Je nach Fall kann sogar eine weitere Strafe geltend gemacht werden, wenn es sich ebenso um einen Verstoß gegen das Pflichtversicherungsgesetz handelt. Dies ist eine Straftat und wird mit einer Freiheitsstrafe von sechs Monaten oder einer Geldstrafe bestraft.
FAQ zur Zwangsstilllegung
In manchen Fällen kannst Du eine Zwangsabmeldung auch selbst veranlassen. Dies ist beispielsweise dann möglich, wenn es einen Kaufvertrag über ein Fahrzeug gibt, welches bisher noch nicht abgemeldet wurde. Ist im Vertrag eine Regelung enthalten, die besagt, dass der Käufer verpflichtet ist, das Auto abzumelden und im nächsten Schritt auf seinen Namen anzumelden und die Umschreibung erfolgt nicht in der angegebenen Frist, dann kann der Verkäufer eine Zwangsabmeldung beantragen. Über die für den Kreis zuständige Zulassungsstelle kann dies erfolgen. Hierfür sind übrigens keine Papiere notwendig. Ein Vertrag, der den Sachverhalt festhält, ist ausreichend.
Damit Du das Fahrzeug wieder zulassen kannst, darf es höchstens sieben Jahre abgemeldet sein. Sind sieben Jahre nach der Abmeldung vergangen, verfällt die Betriebserlaubnis und die Zulassungsbescheinigung I ist ungültig. Nutzt Du das Fahrzeug weiterhin, droht ein Bußgeld von 50 Euro. Bei einer zusätzlichen Beeinträchtigung der Umwelt oder Gefährdung des Straßenverkehrs fallen sogar 90 Euro Strafe an.
Die Fristsetzung zur Beseitigung eines Mangels, der zur zwangsweisen Stilllegung des Fahrzeugs durch das Ordnungsamt oder die Polizei führt, ist unterschiedlich. Bei einem Fehlen des gesetzlichen Versicherungsschutzes kann das Fahrzeug beispielsweise bereits nach drei Tagen stillgelegt werden. Ist die Stilllegung erfolgt, hast Du sieben Jahre Zeit, bis die Wiederzulassung bei einer Zulassungsstelle nicht mehr möglich ist.
